  1. CHECK IN/ OUT

    Check-In is from 3pm by 'Meet and Greet' service with Management at the Property at a time agreed, or otherwise by arrangement. If your arrival will be delayed you must contact the person whose details are given on the booking confirmation email so that alternative arrangements can be made, otherwise a Call-Out fee may be charged by Management. If you fail to arrive by midday on the day after the Arrival Date and you do not advise the contact of your anticipated late arrival, we may treat the Booking as having been cancelled by you and we shall be under no obligation to refund. Check-Out is by 10 am unless by prior arrangement. An early Check-In and late Check-Out may be available, however is subject to prior arrangements and availability and will incur a charge. The property should be vacated at the agreed time and secured. All windows and doors are to be locked. All keys must be returned as directed by Management.
  2. PAYMENT BY DIRECT BANK DEPOSIT

    Payment is required to confirm the booking. Payment in full is required unless by arrangement. Payment is by Direct Deposit to the nominated bank account
  3. ACCEPTANCE & RESPONSIBILITY

    Payment constitutes acceptance of these ‘Terms and Conditions’ as a Booking Contract emailed to the Guest prior to payment and a hard copy for signing by the Guest at the Property.
  4. REFUNDABLE DAMAGE DEPOSIT (RDD)

    A Refundable Damage Deposit (RDD) of $600 is required for all stays to be received by Management before access to the Property. The $600 RDD may be paid by Direct Deposit at least 3 working days prior to arrival date, by online payment system if available, or in cash only on arrival, and will be receipted. Payments online may include a hold of $600 RDD against the same credit card used to make the accommodation payment. Funds may be deducted from the same card against any loss in accordance with these terms and conditions. The RDD will be returned to your nominated bank account in accordance with the provisions of these Terms and Conditions, after your departure when the property has been inspected, cleaned and deemed left in a similar state to your arrival. See Section 10 ‘Your Obligations’.
  5. CANCELLATION

    Cancellation made more than 21 days in advance of the agreed booking will incur loss of 50% of the total booking tariff unless the Property is re-let for the period cancelled, in which case a full refund less $100 administration fee will be credited to your nominated bank account by Direct Deposit. Cancellation made within 21 days of arrival will incur full loss of booking tariff unless the Property is able to re-let for the period cancelled, in which case a full refund less $100 administration fee will be credited to your nominated bank account by Direct Deposit. If you wish to vary or cancel your Booking please contact Owner/Manager immediately. We have a minimum nights’ stay policy of 2 or 7 nights. No refund will be made for a variation to the extent that it changes reservation dates and/or breaches our minimum nights stay policy. A variation of the Booking which changes dates or reduces nights of stay will be treated as a cancellation of the Booking in respect of those nights. The booking is made in good faith however may be subject to any change as notified by the owner prior to the commencement of the booking. If the Property becomes unavailable for your occupancy due to unforeseen circumstances (e.g. fire, storm, damage, etc) Management will inform you immediately and any moneys paid will be refunded in full, however we will not be liable to refund you for any fees you may have paid to any third party in connection with your holiday (including, without limitation, fees for travel, entertainment, activities or insurance).
  6. CONDITION OF THE PROPERTY

    Great care is taken to ensure the Property is in excellent condition, including Management greeting each guest personally and inspection of the Property with you on your arrival. Professional cleaning of the house, towels and linen is provided in the tariff. We know that accidental breakages are sometimes unavoidable and ask that you inform Management at the time if this occurs.
  7. ADJOINING ACCOMMODATION EXCLUDED FROM USE

    JONES BEACH HAVEN has a self-contained flat with seperate side entry attached to the home which may be tenanted by a single adult during your stay and which is not included in the accommodation booked by the Guest.
  8. PARKING

    Please park in JBH designated carport, tandem to the carport or on-road, careful not to obstruct driveways.
  9. LINEN AND TOWELS

    Linen and bath towels are supplied. Guest to provide own beach towels. The cost of replacement for linen and towels remaining stained after washing and bleaching will be debited from the RDD.
  10. PETS

    Pets are not allowed at the Property unless permitted by us in writing in advance. An excess cleaning fee may be deducted from the RDD if pets are present during the stay.
  11. PARTIES & FUNCTIONS

    Parties and Functions are strictly prohibited. We do not accept bookings for Bucks Parties, Hens Nights, or Schoolies Groups. A breach of these conditions will result in immediate termination and eviction (no mater what time of day or night), without refund. Additional charges for security, cleaning, garbage removal, wear and tear, repairs etc will be deducted from your Bond. This is a residential neighbourhood. All noise affecting others is to cease by 10pm. Neighbours have 24 hour complaint phone number to contact and if this number is called, result will be loss of a portion or all of the Refundable Damage Deposit.
  12. SMOKING

    Smoking is not permitted in the property under any circumstance. If you choose to smoke outside, cigarette butts are to be disposed of in bins provided.
  13. VISITORS

    Visitors are welcome to visit you at the property, however must depart quietly prior to 11.30pm on Friday and Saturday nights and 10pm on all other nights. The number of visitors at the property must be maintained at a reasonable level (maximum 4 visitors at any one time), to ensure neighbours are not impacted in terms of excessive noise and street parking.
  14. NOISE

    During your stay noise is be kept to a reasonable level, particularly after 10pm and before 9am. After 10pm noise that may be audible by neighbours is to cease.
  15. YOUR OBLIGATIONS

    You agree to comply with use of the property as set out in these Terms and Conditions, the property manual at the Property, and any other regulations reasonably specified by Management from time to time concerning occupancy, property, health, safety and quiet enjoyment of the Property and our neighbours, and ensure that they are observed by all members of your party. You are responsible for damage, breakages, theft and loss of the Property and any part of it by yourself, guests or visitors during your stay, and for notifying the Management of any occurrence. Management may recover from you expense incurred as a result of your stay or breach of these Terms & Conditions, including charge against the RDD at Management's discretion. Examples include, but are not limited to, cleaning charges in excess of the regular cleaning costs, any breakage, damage, loss, stains, extra guest/s beyond those agreed to stay, excessive noise after 10 pm resulting in complaint by neighbours. You agree to keep and leave the Property, furnishings and contents clean and in good condition including items such as BBQ and kitchen equipment. You agree not to move furnishings or cause any damage to the walls, doors, windows or any other part of the Property nor to do anything that may be reasonably considered to cause a nuisance or annoyance to us or to any other occupier of adjoining or neighbouring properties. Before departure you agree to remove all food including contents of fridge and freezer, and rubbish, and dispose in the appropriate council rubbish bins provided. You agree ensure crockery and cutlery is clean, packed away and the dishwasher is emptied. If not excess cleaning fee may be charged against your RDD. Guests staying on Mondays agree to place bins at kerbside Monday nights for collection Tuesday morning. The number of guests is as agreed by Management at the time of booking (maximum 7). You cannot allow more people to stay in the Property than expressly authorised, nor can you significantly change the makeup of the party during your stay in the Property. We will treat any of these circumstances as a cancellation of the Booking by you and we shall be under no obligation to refund you for any fees already paid to us in those circumstances. Any refund will be at our sole discretion. You are responsible for the safekeeping of 2 accommodation keys. Replacement of lost keys will incur additional charges. You agree to allow us or any representative of ours access to the Property at any reasonable time during your stay for the purpose of essential repairs, in an emergency or to ensure you are complying with this Booking Contract.
  16. LIABILITY

    You agree to take all necessary steps to safeguard your personal property while at the Property and we recommend you take have relevant travel and health insurance. The property owner takes no responsibility for the personal possessions of you, your guests or visitors. Vehicles and possessions are left entirely at your own risk. Children must be supervised at all times. Children brought to the property are brought at your own risk and Management bear no responsibility for their safety during your stay.
  17. PROBLEMS OR COMPLAINTS

    In the case of any problem or complaint, you must inform Management at the earliest opportunity so Management has the chance to rectify the situation as quickly and efficiently as possible. You must allow repair/service access to the property during reasonable hours. Any complaint, which cannot be resolved locally, must be notified in writing to Management prior to departure from the Property. Failure to follow this procedure this may hinder the ability of Management to rectify the problem or complaint and reduce or extinguish any claim you may have. We recommend all guests purchase travel insurance since Management are not responsible for any injuries, illness or accidents that may occur whilst staying at our property.
  18. DEFINITIONS

    'Booking' means the period for which you have paid to stay at the Property. 'Property' means the 4 bedroom 2 bathroom advertised self contained accommodation, 'Jones Beach Haven', at 10 Moona Ave Kiama Downs NSW 2533, its fixtures, fittings and equipment, excluding the private rental apartment with seperate entry accommodating a maximum of one occupant. 'Management' means the Property Owner and Staff employed by the owner as Managers of the Property. 'Guests' means the persons who stay overnight in the Property during the Booking. "Visitor" means a person a Guest permits to visit the Property during the Booking.
